Fire Hydrant Use and Ordinance

9-4C-14: USE OF FIRE HYDRANTS BY UNAUTHORIZED PERSONNEL:


A. It shall be unlawful for any person, except a duly authorized officer, agent or employee of the Village, to cause water to flow from any public or private fire hydrant without a fire hydrant use permit issued by the Director of Public Works, or his/her designee.

B. Each applicant for a fire hydrant use permit shall be required to deposit with the Village the sum of seven hundred fifty dollars ($750.00) for the use of a large hydrant meter and hydrant wrench, or two hundred fifty dollars ($250.00) for the use of a small hydrant meter and hydrant wrench. The fire applicant meter must be installed by the applicant and maintained in good condition for the duration of the period during which the fire hydrant is in use. Upon completion of the fire hydrant use, the hydrant meter and hydrant wrench shall be returned to the Village in good operating condition. Water use recorded on the hydrant meter shall be charged at the rates specified in subsection C of this Section, to which shall be added a minimum daily fee of six dollars ($6.00) for the use of the large hydrant meter, three dollars ($3.00) for the use of the small hydrant meter, and one dollar ($1.00) for the use of the hydrant wrench. These charges shall be deducted from the aforementioned deposit, and the balance of the deposit shall be refunded upon return of the hydrant meter and hydrant wrench. Any damages to the hydrant meter or hydrant wrench shall also be deducted from the deposit before refund is made. Any damages to the Village's water system caused by the careless opening and closing of hydrants shall also be paid by the applicant from the deposit, or otherwise, if in excess of the deposit balance.

C. Water used from any fire hydrant shall be billed at the following rates:

1. First ten thousand (10,000) gallons - a flat fee of twenty dollars ($20.00).

2. Any amount over ten thousand (10,000) gallons - two dollars ninety six and two-tenths cents ($2.962) per one thousand (1,000) gallons or portion thereof.

D. A fire hydrant use permit shall be valid for a period of fifteen (15) days from the date of issuance. Within three (3) days of the expiration of a fire hydrant use permit, the permittee shall return the fire hydrant meter and hydrant wrench to the Village. If the permittee fails to do so, a written notice to return the hydrant meter and hydrant wrench shall be forwarded to the permittee, by first class U.S. mail, at the address indicated on the fire hydrant use permit application. If the permittee fails to return the hydrant meter and hydrant wrench to the Village within seven (7) days of the date of said notice, the permittee shall be deemed to have purchased said hydrant meter and hydrant wrench from the Village for the amount of the deposit referenced in subsection B of this Section, and the Village shall retain the entire deposit. The retention of said deposit, however, shall not relieve the permittee from his/her/its obligation to pay for the cost of the actual amount of water used by the permittee. (Ord. 98-22-100, 07-09-34)
